1. Our Role and Services

LuxAura RegTech Advisory ("LRT") is a technology advisory firm specializing in:

• Compliance-by-design consulting for financial institutions.

• Advisory on middleware solutions (e.g., LuxAura LinkAI) for collateral verification and regulatory alignment.

2. What We Are NOT

LRT explicitly does not operate as:

• A law firm, accounting firm, or financial services provider.

• An EU Notified Body (under EU AI Act Article 43 or DORA Article 28).

• A provider of formal regulatory conformity assessments or certifications.

3. Regulatory Alignment Framework

Our advisory frameworks are designed to support compliance with (but do not certify) the following:

• EU AI Act (2024/1689): Articles 6, 10, 12, 15, 16 → Symbolic AI risk engine, immutable audit logs, cross-validation.

• DORA (2022/2554): Articles 6, 8, 10, 11, 12, 28 → ICT risk management, anomaly detection, 2-hour incident response SLA, third-party risk controls.

• MiCA (2023/1114): Asset tokenization → Digital Product Passport (DPP) integration, cryptographic proofs.

• AMLD6/DAC8: Cross-border reporting → Compliance frameworks, selective auditability.

⚠️ Critical Notes:

• LRT does not perform EU AI Act Annex III classification or conformity assessments.

• High-risk AI obligations (EU AI Act) apply from December 2, 2027—clients must ensure their own compliance.

4. Client Responsibilities

As a financial institution, you retain sole responsibility for:

• Compliance with all applicable laws (EU AI Act, DORA, MiCA, etc.).

• Credit risk, underwriting, and data accuracy (LRT is an advisory-only provider).

• Audit trails (we provide tools and frameworks; you maintain official records per DORA Article 11).

5. Disclaimers (Regulatory)

• Not a Notified Body: LRT is not accredited under EU AI Act Article 43 or DORA Article 28.

• No Formal Certification: Our technical mappings are informational only and do not constitute:

  • A Certificate of Regulatory Conformity.

  • A legal opinion on compliance.

• Independent Verification Required: You must engage your own legal/compliance advisors to validate classifications and processes.
